Diner robber sentenced to 8 years

MIAMI COUNTY — During a sentencing hearing on Monday, Miami County Common Pleas Court Judge Jeannine Pratt praised the quick action of a local resident who apprehended the man who robbed two diners last November.

Judge Pratt sentenced Walter C. Schwytzer III, 44, of Englewood, to serve eight years in prison on two counts of first-degree aggravated robbery charges for robbing the Pearson House in West Milton on Nov. 27 and then the Tipp O’ the Town restaurant in Tipp City the next day on Nov. 28, 2015. Schwytzer entered both restaurants and handed the clerk a note stating he had a gun and demanded cash.

Following the robbery of Tipp O’ the Town restaurant, Schwytzer fled on foot as a patron chased him out to the parking lot as he attempted to get away in a car. The man, who asked to remain anonymous, was a CCW carrier and held Schwytzer at gunpoint with his pistol until authorities arrived minutes later. Judge Pratt thanked the man by name in court for his assistance in apprehending Schwytzer before Tipp City Police arrived on the scene.

Public defender Jack Hemm requested Judge Pratt honor the joint plea agreement with the state and note Schwytzer’s 115 days of jail time credit prior to sentencing.

Miami County Assistant Prosecutor Paul Watkins stated the crimes were “serious, violent offenses,” and noted Schwytzer’s four prior prison terms before he was sentenced for the diner robberies.

“I’m sorry for what I’ve done,” Schwytzer said in court. “I’ve had a problem with drug addiction and I make poor decisions when I’m on drugs — I’m sorry for what I’ve done.”

Schwytzer was sentenced to serve eight years in prison for each count of aggravated robbery. The sentences will run concurrently and he must serve five years mandatory post-release control following his release from prison. He was ordered to pay $300 in restitution to the Pearson House, plus court costs.
